What a Courthouse Wedding Actually Costs (And What It Does Not)

You open the county clerk page expecting your courthouse wedding to cost nothing. The page shows a marriage license fee. A separate ceremony fee appears below it. Then you notice a witness rule that may require another person to show up.

Courthouse means the government handles a smaller part of the day. It does not mean every county gives you the same package or charges the same amount. The license, ceremony, witness rule, waiting period, and payment method can all depend on where you apply.

The total gets confusing because two different budgets are usually mixed together. One covers the legal ceremony. The other covers the day you choose to build around it.

Start by separating them.

What the county can charge you for

The government side can contain three lines:

1. Marriage license: $____

2. Civil ceremony: $____

3. Witness provided by the clerk, if offered and needed: $____

Add those three lines:

Marriage license + civil ceremony + clerk provided witness = government subtotal

Leave each space blank until the official clerk page supplies the amount. A license may be the only government fee on one page. Another office may list the license and ceremony separately. A county may require a witness, provide one for a fee, or require none.

Ask the clerk or a qualified professional about eligibility, a previous divorce, immigration, or changing a name.

Three local examples from official pages

The examples below were checked August 28, 2026. Their differences show how much local rules can change.

New York City: $60 in listed government fees

New York City lists a $35 marriage license and a $25 civil ceremony. The arithmetic is simple:

$35 license + $25 ceremony = $60 government subtotal

The NYC311 marriage license page lists a 24 hour wait. A judicial waiver can remove the wait, and NYC311 says the waiver has no fee. The NYC311 marriage ceremony page requires one witness who is at least 18 and has the same type of photo identification used for the marriage license. Bringing your own eligible witness keeps the listed government subtotal at $60.

Los Angeles County: $126, or $146 with a clerk provided witness

Los Angeles County lists a $91 public marriage license and a $35 civil ceremony on its official fee page.

$91 public license + $35 ceremony = $126 government subtotal

The California Department of Public Health says a public license needs one witness signature. Los Angeles County charges $20 when the clerk's office provides that witness.

$126 subtotal + $20 clerk provided witness = $146

Bring your own eligible witness and the government subtotal stays at $126. The state's general marriage license page says county fees and hours vary, and a California license remains valid for 90 days.

Harris County: the license changes by $100 with residency proof

The Harris County Clerk lists an $81 marriage license with proof of Texas residency on a valid identification card and $181 without that proof.

$181 license minus $81 license = $100 difference

Harris County requires no witness for the license or ceremony. It lists a 72 hour wait, automatically waived for active duty military who present military identification. Leave the ceremony line blank until the office or person performing it confirms any charge.

Using the New York City fees, the government subtotal is $60 for the license and civil ceremony. An outfit, photographer, ride across town, bouquet, and dinner afterward can each produce another bill. The clerk neither requires nor includes any of them.

To price your courthouse wedding, open your own county clerk page this week and fill the first three lines. Record the fee, waiting period, witness rule, payment method, and license validity. Save the link and write “checked” with today's date. If the page is unclear, contact that clerk directly.

Then put the waiting period and witness rule on your calendar. A ceremony date that ignores either one can create a rushed phone call or a second trip to the clerk.
